... Petitioners.
Mr. Ranabir Roy Chowdhury, Mr. Raushan Kumar Ray, Mr. Subhamoy Dutta, Mr. Abhinash Poddar
... For the Petitioners.
Dr. Pradip Banerjee, APP, Ms. Hasi Saha, Mr. Dipak Khetawat
... For the State.
Mr. Avik Ghatak, Mr. A. Parekh, Mr. D. Mukherjee, Mr. Rosan Singh
... For the de facto complainant.
Learned advocate appearing for the petitioners submits that petitioners have been falsely implicated in connection with the instant case, although the petitioners informed the police station, but no action was taken on the information furnished by the petitioners. Learned advocate appearing for the de facto complainant opposes the prayer for anticipatory bail. Learned advocate appearing for the State produces the case diary and draws the attention of the Court to the statement of the injured as well as the injury report.
2 I find that both the petitioners were responsible for the injuries and five stitches were administered on the victim. Having considered the same, I am of the opinion that this is not a fit case for granting anticipatory bail to the present petitioners. As such, the prayer for anticipatory bail of the petitioners is rejected. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for anticipatory bail, being CRM (A) 2926 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
