Accused No.3 in Crime No.70 of 2026 registered by Jayaprakashnagar Police Station, Bengaluru City, for offences punishable under Sections 115(2), 140(2), 329(4), 351(2), 352 R/w Section 3(5) of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.70 of 2026 was registered by Jayaprakashnagar Police Station, Bengaluru city for the aforesaid offences against one Praveen and others, based on the first information dated 02.06.2026 received from Chethan V, who is the alleged victim in the present case. During the course of investigation of the said case, petitioner herein was arrested on 18.06.2026 and remanded to judicial custody. In his remand application, petitioner was arraigned as accused no.3. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.6883 of 2026 was rejected on 18.07.2026. Accused Nos.6 and 7 as against whom, similar allegations are found in the present case had approached this Court in Criminal Petition No.8883 of 2026 which was allowed on 31.07.2026. In paragraph nos.4, 5 and 6 of the order passed in Criminal Petition No.8883 of 2026, it is observed as follows: "4. In the first information dated 02.06.2026 submitted by the alleged victim, he has stated that he and accused no.1 are involved in Crime No.102 of 2025 registered by Banashankari Police Station and in the said case they were arrested and sent to jail. Accused no.1 - Praveen had demanded money from the victim in the present case, who was in custody in Crime No.102 of 2025 along with the accused no.1, for the purpose of making arrangements for filing necessary application to be released on bail in Crime No.102 of 2025. 5. The victim allegedly had not paid any money to accused no.1. After the victim in the present case and accused no.1 were released from jail in Crime No.102 of 2025, accused no.1 along with his friends had entered into the house of first informant / victim on 01.06.2026 and had forcibly taken him along with them and thereafter, assaulted him demanding money. Subsequently, they had - 4 - HC-KAR CNR: KAHC010622302026 NC: 2026:KHC:49580 CRL.P No. 13899 of 2026 released the victim and thereafter he had approached the police. 6. Undisputedly, name of petitioner's is not found in the FIR registered in the present case nor they are accused in Crime No.102 of 2025 registered by Banashankari Police Station in which accused no.1 in the present case as well as the victim are arraigned as accused. Victim has not suffered any grievous injury as a result of assault committed by the other persons, who allegedly were present along with accused nos.1 and 2 in the present case. It is not in dispute that, petitioners herein do not have any other criminal antecedents. Major portion of the investigation in the case is now completed". 5. Subsequently, following the said order, accused No.8 was granted regular bail by this Court in Criminal Petition No.13488 of 2026 vide order dated 02.09.2026. It is not in dispute that the petitioner has no other criminal antecedents. Under the circumstances, the following:- ORDER (i) Criminal petition is allowed. (ii) The petitioner is directed to be enlarged on bail in Crime No.70 of 2026 registered by Jayaprakashnagar Police Station, Bengaluru - 5 - HC-KAR CNR: KAHC010622302026 NC: 2026:KHC:49580 CRL.P No. 13899 of 2026 City, for offences punishable under Sections 115(2), 140(2), 329(4), 351(2), 352 R/w Section 3(5) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
