Learned advocate for the petitioner submits that the petitioner is innocent and he was a driver of a vehicle from where there has been recovery of 1260 bottles of Wincerex cough syrup. According to the petitioner seizure was made in front of the medicine shop owner and it was the said medicine shop owner who had no knowledge regarding the complicity of the present petitioner and the materials which have been seized. The medical shop owner was also available in the vehicle. Learned advocate for the State opposes the prayer for bail. I have taken into account the time of the seizure which is at midnight.
2 Having regard of the quantum of seizure which is of commercial quantity, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (NDPS) 1926 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
