Mr. Sanjay Bhatt, learned counsel for the petitioner. 2. Mr. Ghanshayam Joshi, learned Additional C.S.C. for the State of Uttarakhand. 3. Mr. Rajesh Sharma, learned counsel for the respondent-Uttarakhand Forest Development Corporation. 4. Petitioner is reportedly serving as Cook in Uttarakhand Forest Development Corporation since 2015. Since his claim for regularisation has not been considered, therefore, he has approached this Court seeking the following reliefs: - (i) Issue a writ, order or direction in the nature of mandamus directing the respondents to consider claim of Petitioner for regular status in the Respondent corporation against the vacant post occupied by him w.e.f. the date of his initial engagement and pay the consequential benefits. (ii) Issue a writ, order or direction in the nature of mandamus directing the respondents to pay the salary and other allowances to the Petitioner at par to the regular group “D” employees of the corporation in the principle of “equal pay for equal work” along with dearness allowance and arrears, till the Petitioner is given regular status. 5. Learned counsel for the petitioner submits that after serving for more than ten years as Cook, petitioner is also entitled for minimum of pay scale, besides regularisation. 2026:UHC:1946 6. Learned State Counsel as well as learned counsel appearing for the Corporation submit that since petitioner has sought a writ of mandamus and he has also made a representation to the Competent Authority in the Corporation, therefore, the writ petition can be disposed of by directing the Competent Authority to take decision thereupon. 7. Learned counsel for the petitioner, however, submits that petitioner be permitted to make fresh representation to the Competent Authority. 8. The writ petition is, accordingly, disposed of with liberty to petitioner to make fresh representation to Managing Director, Uttarakhand Forest Development Corporation, within two weeks from today. If he makes representation within the stipulated time, Managing Director shall take decision, as per law, within four months thereafter.
