The Civil Revision has been preferred praying for expeditious disposal of the suit being Title Suit No. 59 of 2013 pending before the Civil Judge, Senior Division, 1st Court at Alipore. 2. The prayer for expeditious disposal is made by the defendant/petitioner herein who submits that an application under Order 7 Rule 11 CPC is still pending disposal before the Trial Court since 2013. 3. On hearing the learned counsels for the parties and on perusal of the materials on record it appears that the suit before the Trial Court is a suit for partition on cancellation of sale deed but the fact remains that the suit is pending for about 12 years. 4. Considering all this, the Civil Revision is disposed of with the direction that the Trial Court shall make all endevour to dispose of the application under Order 7 Rule 11 CPC within one months from the date of communication of this order and also make all endevour to dispose of the suit finally preferably within a year from the date of this order. 2 5. Revisional application stands disposed of. 6. Photostat certified copy of this order, if applied for, be given to the parties on priority basis upon compliance of all formalities.
