JUSTICE ANU SIVARAMAN) This Writ Petition (Habeas Corpus) is filed seeking to issue a writ in the nature of Habeas Corpus against respondents No.1 to 5 to secure and produce the detenue before this Court. 2. We have heard Shri. Somashekara K.H, learned counsel appearing for the writ petitioner and Shri. B.N. Jagadeesha, learned State Public Prosecutor-I appearing for respondents No.1 to 5. 3. The detenue as well as respondent No.6, were produced before us by Smt. Savithri, WPC 16499 and Shri. Kumar Patil, PSI, Bagaluru Police Station, Bengaluru. 4. We interacted with the alleged detenue, aged about 19 years, who informed us that she is not under any illegal detention and that she has married the respondent - 4 - HC-KAR CNR: KAHC010623732026 NC: 2026:KHC:48596-DB WPHC No. 92 of 2026 No.6 and is living in his house. She stated that there was a threat from the members of her family and that she may be provided with Police protection to enable her to live with respondent No.6. 6. We have also interacted with respondent No.6, who informed us that he had married the alleged detenue and that his parents are agreeable to the said marriage. 7. We interacted with the writ petitioner and the members of the family as well, who informed us that they are willing to allow the alleged detenue to go and live with her in-laws, now that she is married, but, there should be no interference with their lives and that they shall not be troubled unnecessarily by respondent No.6 or his family members. 8. Having considered the contentions advanced and having interacted with the alleged detenue, we are of the opinion that, since the alleged detenue has clearly stated that she is not under any illegal detention and that - 5 - HC-KAR CNR: KAHC010623732026 NC: 2026:KHC:48596-DB WPHC No. 92 of 2026 she is married to respondent No.6, she has to be permitted to reside with respondent No.6 according to her wishes. 9. Accordingly, the Writ Petition (Habeas Corpus) is disposed of. However, in the event of any information as to apprehension of threat from the alleged detenue or from the writ petitioner, the jurisdictional Police shall take appropriate steps to ensure that Law and Order is maintained.
