ORAL ORDER
The petitioners are before this Court calling in question proceedings in C.C.No.58690/2026, pending before the XXIX Addl. Chief Judicial Magistrate, Mayohall, Bengaluru, for the offences under Section 106 of the BNS, 2023. 2. Heard Sri. N. Hariprasad, learned counsel appearing for the petitioners, Smt. Deepthi Alva, learned HCGP appearing for respondent No.1, Sri. Roshan M.C., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a joint affidavit. The joint affidavit reads as follows:

“JOINT AFFIDAVIT
We, 1) Sri. Harish.R, S/o Ravindra. N Aged about 31years, R/at No.31, 1st main, 4th Cross, Near Government school, Kadubisanahalli, Bengaluru- 560103., 2) Smt.Bhagyashree, W/o late Basavaraj, Aged about 25 years, C/o Chandrashekhar Labour Shed, Kittaganur Road, do hereby Halehalli, K.R.Puram, Bengaluru-560036 solemnly affirm and state on oath as follows:
1. It is submitted that, first of me is the petitioner No.2 and second of me is the respondent No.2 in the above, we know the facts and circumstances of the case, hence we are swearing to this affidavit on behalf of our-self and on behalf of others. 2. It is submitted that both of them have settle their issue with free will and they are not intending to proceed further in terms of the settlement. 3. It is submitted that, the son of the first petitioner by name (Siddartha Gangodi) herein has voluntarily agreed to compensated the deceased laborer's family for a sum of Rs.12,00,000/-., out of 12 lakhs, 7,00,000/- has been already paid to the victims i.e., mother of the deceased and deceased wife. 4. It is submitted that, out of the balance amount of Rs,5,00,000/- a sum of Rs.2,50,000/- through RTGS vide reference No.ICICR12026090212601842 to the deceased mother Smt.Subbavva, and a sum of Rs.2,50,000/- through RTGS vide reference No.ICICR12026090212601895 to the deceased wife Smt.Bhagyashree. PRAYER
WHEREFORE, we humbly pray this Hon'ble Court may be pleased to accept the joint affidavit, in the interest of justice and equity.”

The petitioners have handed over demand draft of Rs.12,00,000 to the respondent-complainant who is present before the Court in the light of settlement arrived between the parties. 5. In the light of the joint affidavit and offences not being against the State, I deem it appropriate to accept the same and terminate the proceedings against the petitioner in the subject petition. 6. For the aforesaid reasons, the following:
ORDER i. Criminal Petition is disposed. ii. Proceedings in C.C.No.58690/2026 pending before the XXIX Addl. Chief Judicial Magistrate, Mayohall, Benagluru, stands quashed qua the petitioners.
