Hon’ble Shri Justice Rakesh Mohan Pandey Order on Board 08/10/2026
1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) for grant of regular bail to the applicant in connection with the Crime No.181/2026, registered at Police Station Bodhgath, District Bastar, Chhattisgarh for the offences NIRMALA RAO
2 punishable under Section 21(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, NDPS Act). 2. The case of the prosecution, in brief, is that the police of Police Station Bodhgath, District Bastar, received secret information, conducted a raid, and seized 53 Pyeevon Spas Plus Tramadol HCL and Acetaminophen Capsules, weighing 284.08 gms. (each capsule weighing 0.67 gm., totalling 424 capsules), from the joint possession of the accused persons. Thereafter, the aforesaid offence was registered against the applicant. 3. Learned counsel for the applicant would submit that the applicant is innocent and has been falsely implicated in the case. He further submits that, although the quantity of contraband seized is above the commercial quantity, the seizure was not carried out in accordance with the provisions contained in the NDPS Act and the Rules framed thereunder. He would submit that, before weighing the seized contraband, the Investigating Officer recorded his finding with regard to the weight of one capsule. He would further submit that, according to the Rules, each packet of contraband should have been seized and marked separately. Thus, he prays that the applicant may be enlarged on regular bail. 4. On the other hand, learned State counsel opposes the bail application and submits that contraband weighing more than the commercial quantity was seized from the joint possession of the two accused persons. He would submit that the Investigating Officer complied with all the mandatory requirements while conducting the search and
3 seizure. He would further submit that the application filed by the applicant deserves to be dismissed. 5.
Heard learned counsel appearing for the parties and perused the case diary. 6. Having considered the quantity of contraband, which is above the commercial quantity, and having regard to the stringent conditions under Section 37 of the NDPS Act, this Court is not satisfied that there are reasonable grounds for believing that the applicant is not guilty of the alleged offence or that he is not likely to commit any offence while on bail. Consequently, this Court does not find it to be a fit case for grant of regular bail. 7. Accordingly, the first bail application filed by the applicant is hereby rejected. Sd/-
