Accused No.4 in Crime No.79 of 2025 registered by Mandya West Police Station, Mandya District for the offences punishable under Sections 238, 61(2), 336(3), 318(2), 318(4), 316(2), 340(2) R/w Section 3(5) of BNS, 2023 is before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.79 of 2025 was registered by Mandya West Police Station, Mandya District against one Sri Praveen and others, based on first information dated 23.05.2025, received from Sri Shridar S/o Late Siddegowda. After completing investigation in the said case, charge sheet is filed against four persons. Apprehending arrest in the said case, petitioner had approached the jurisdictional Sessions Court in Crl.Misc.No.130 of 2026, which was rejected on 03.03.2026. Therefore, he is before this Court. - 3 - HC-KAR CNR: KAHC010550152026 NC: 2026:KHC:49581 CRL.P No. 12076 of 2026 4. Petitioner's name is not found in the FIR. Accused no.1 named in the FIR is the brother of the petitioner and it appears that he was holding a license to run a jewelery shop in the name of "Anagha Gold Pawn Brokers". The first informant has alleged that he had pledged gold in the aforesaid finance company known as "Anagha Gold Pawn Brokers" and had borrowed money. Subsequently, it was found that the aforesaid finance company was closed and it is under these circumstances, he had approached the police. 5. Charge sheet material would go to show that petitioner is arrayed as accused no.4 in the charge sheet. Accused nos.1 to 3 have been granted police bail in the present case. Except stating that petitioner is the brother of accused no.1, there is no other serious allegation as against the petitioner. Investigation of the case is already completed and charge sheet is filed. Under the circumstances, the following:- ORDER (i) The Criminal Petition is allowed. - 4 - HC-KAR CNR: KAHC010550152026 NC: 2026:KHC:49581 CRL.P No. 12076 of 2026 (ii) The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.79 of 2025 registered by Mandya West Police Station, Mandya District for the offences punishable under Sections 238, 61(2), 336(3), 318(2), 318(4), 316(2), 340(2) R/w Section 3(5) of BNS, 2023, subject to the following conditions: 1. The petitioner shall appear before the Investigating Officer in the present case within a period of fifteen days from the date of receipt of certified copy of this order on executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum to the satisfaction of the jurisdictional Court. 2. The petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3.
