THIS CRIMINAL PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioners are before this Court seeking for the following reliefs; a) Quash the entire proceedings in C.C.No.4843/2024, pending on the file of VII Addl. Chief Judicial Magistrate Court, at Bengaluru for the offences punishable under Section 312, 323, 420, 498-A, 504, 506 and 201 of IPC and Under Section - 3 - HC-KAR CNR: KAHC010010732025 NC: 2026:KHC:48912 CRL.P No. 331 of 2025 3 and 4 of Dowry Prohibition Act (Vide Annexure-D) and b) Grant such other reliefs as this Hon’ble Court may deem fit in the facts and circumstances of the case in the interest of justice and equity. 2. Petitioner No.1 is the husband of respondent no.2; petitioners No.2 and 3 are the siblings of petitioner No.1 and petitioner No.4 is the father of petitioners no.1 to 3. 3. There being certain matrimonial disputes, respondent no.2 filed a complaint which came to be registered as Crime No.120/2023 by the Kodigehalli Police Station for offences under Section 312, 323, 420, 498A, 504, 506, 34 of the IPC and Section 3 and 4 of the Dowry Prohibition Act, 1961. The disputes between the parties also reached the Family Court, in pursuance thereof, the matter had been referred to mediation and during the course of mediation, petitioner no.1 and respondent no.2 arrived at a settlement which was recorded in a Memorandum of Settlement under Section 89 of the CPC read with Rules 24 and 25 of the Karnataka Civil Procedure (Mediation) Rules, 2005. 4. In terms of the said settlement, respondent no.2 had agreed to cooperate in closing / quashing the criminal proceedings in CC No.4843/2024, which arose out of Crime No.120/2023, as also certain other proceedings - 4 - HC-KAR CNR: KAHC010010732025 NC: 2026:KHC:48912 CRL.P No. 331 of 2025 which were pending before various courts. The said settlement having been accepted, the marriage between the petitioner No.1 and respondent no.2 has been dissolved by granting decree of divorce on 22.11.2024 by the 4th Additional Principal Judge Family Court, Bengaluru in MC No.5195/2023. 5. Notice having been issued to the respondent No.2, there is no appearance on the part of respondent No.2 in these proceedings. Apparently for the reason that the dispute between the petitioners and respondent no.2 has been settled as per the Memorandum of Settlement indicated supra. 6. In that view of the matter, this Court passes the following: ORDER i) The Criminal Petition is allowed. ii) Respondent no.2 having agreed to cooperate in the quashing of the present proceedings, the entire proceeding in CC No.4843/2024 arising out of Crime No.120/2023 pending on the file of the 7th Additional Chief Judicial Magistrate, Bengaluru is hereby quashed.
