JUSTICE S VISHWAJITH SHETTY ORAL ORDER This petition is filed under Section 483(1)(b) of BNSS, 2023 with a prayer to relax condition No.(e) imposed by this Court in Crl.P.No.7442 of 2026 vide Order dated 07.07.2026. 2. Heard the learned counsel for the petitioner and learned Additional State Public Prosecutor on behalf of the respondent-State. 3. This Court has disposed of Crl.P.No.7442/2026 vide order dated 07.07.2026 and has granted regular bail to the petitioner herein, who is accused No.3 in SC.No.62/2026 pending before the Court of I Addl. District and Sessions Judge, Kolar, arising out of Crime No.246/2025 registered by Vemagal Police Station, Kolar, for the offences punishable under Sections 103(1), 61(2)(a), 238(a) and 3(5) of BNS, 2023. 4. Condition No.(e), imposed by this Court in Crl.P.No.7442/2026, vide order dated 07.07.2026, reads as follows: "e) The petitioner shall not leave the jurisdiction of the trial Court without permission of the said Court until the case registered against him is disposed off." 5. Learned Counsel for the petitioner submits that petitioner hails from Orissa State and his wife is a Police Constable at - 3 - HC-KAR CNR: KAHC010609722026 NC: 2026:KHC:48095 CRL.P No. 13701 of 2026 Orissa. He submits that impugned condition imposed by this Court in Crl.P.No. 7442/2026 has been causing hardship to the petitioner, who was earlier working as a superintendent in a private company at Orissa. 6. Learned Additional State Public Prosecutor fairly does not oppose the prayer made in this petition. 7. Considering the allegation found against the petitioner in the charge sheet and also having regard to the aforesaid submissions, I am of the opinion that the ends of justice would be met if the impugned condition No.(e) imposed by this Court in Crl.P.No.7442/2026 vide order dated 07.07.2026 is relaxed. Accordingly, I pass the following: ORDER i. Criminal petition is allowed. ii. Condition No.(e) imposed by this Court in Crl.P.No.7442/2026 vide order dated 07.07.2026 stands relaxed. iii.
