THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE ANANT RAMANATH HEGDE ORAL ORDER This petition is filed to quash the proceedings in S.C. No.112/2023 pending before Sessions Judge, Ramanagara for the offence punishable under Section 397 of the Indian Penal Code, 1860. The petitioners are accused No.1 and 2 and respondent No.2 is the complainant. 2. Learned counsel for the petitioners and the respondent No.2 are present. The petitioners are present. The complainant is also present. 3. Learned counsel for the petitioners would submit that the niece of the complainant/respondent No.2 is married to petitioner No.1 and it appears that there was opposition to the Digitally Signed by ANANT RAMNATH HEGDE on 09-09-2026 - 3 - HC-KAR CNR: KAHC010092922026 NC: 2026:KHC:48926 CRL.P No. 1948 of 2026 said marriage. The marriage was solemnized on 16.09.2013 and the complaint is filed on 18.04.2014 alleging dacoity. 4. Learned counsel for the petitioners would submit that the proceeding is pending before the Trial Court since last 12 years and it is the further submission that, though the injury is alleged in the complaint, no wound certificate is produced. 5. It is further submitted that, though Rs.1,50,000/- is said to have been robbed, Rs.500/- is allegedly recovered. It is the further submission that Rs.500/- has nothing to do with the alleged offence. 6. In addition, the learned counsel for the petitioners would submits that, the dispute is amicably settled between the parties. The complainant/respondent No.2 has agreed to withdraw the complaint and is not intending to prosecute the petition. 7. It is further submitted joint application is filed and application is signed by the petitioners and respondent No.2. The parties pray to quash the proceeding. The same is also supported by two separate affidavits of the petitioners and respondent No.2. It is not in dispute that the petitioner No.1 has married to the niece of the complainant/respondent No.2. It appears that the complaint is filed because of the animosity resulting from the marriage of petitioner No.1 with the niece of the complainant. 9. Under these circumstances, the Court is of the view that the further prosecution or trial may not serve any purpose and it is likely to be an empty formality. For the aforementioned reasons, the application is allowed. 10. Hence, the following: ORDER (i) The petition is allowed. (ii) The proceedings in S.C.
