Heard the learned counsel appearing for the petitioners.
2. Learned High Court Government Pleader accepts notice on behalf of the respondent No.1.

Learned counsel for the petitioners submits that the petitioner No.1 who is aged 70 executed a gift deed in favour of petitioner No.2 in respect of the property belonging to petitioner no.1. It is the contention of the learned counsel for the petitioners that a third person who has no right over the property in question has allegedly lodged a complaint to the Sub-Registrar, alleging that the documents are fake. 4. It is the further submission that all documents are genuine and for this reason only the document is registered.
Learned counsel for the petitioner would submit that the Sub- Registrar has no jurisdiction to look into the correctness or otherwise of the document and would place reliance on the
judgment of the Co-ordinate Bench of this Court in Smt. Sulochanamma Vs. H. Nanjundaswamy and others1.
5. The Court has considered the contentions raised and perused the records.
6. In the aforementioned judgment, the Co-ordinate Bench of this Court has held that the Sub-Registrar has no jurisdiction to refuse the registration and he has no jurisdiction to look into the genuineness of the document.
7. In the instant case, the Sub-Registrar has not refused the registration. On the other hand, he has registered the document.
8. Later it appears that, a complaint is filed before the Sub-Registrar alleging that the document which is presented for

registration is fake. The Sub- Registrar has doubted the correctness of the document and has filed a complaint invoking Section 82(b) of the Registration Act, 1908, (Act, 1908).
"82. Penalty for making false statements, delivering false copies or translations, false personation, and abetment. - Whoever (a) xxxx (b) intentionally delivers to a registering officer, in any proceeding under section 19 or section 21, a false copy or translation of a document, or a false copy of a map or plan; or
xxxx"
9. To attract Section 82(b) of Act, 1908, it must be pointed out that the documents which is presented for registration is either under Section 19 or under Section 21 of Act, 1908.
10. Section 19 deals with the translated documents. In the instant case, the translated document is not produced for registration. Digitally Signed by ANANT RAMNATH HEGDE on 09-09-2026

11. If the document produced as required in Section 21 of Act, 1908 is not genuine, then the police have to investigate the matter and to proceed further. If the documents are genuine, then the proceedings will have to be closed. However, the investigation cannot be stopped at this stage. It is for the police to look into the genuineness of documents produced along with the document presented for registration.
12. With these observations, the petition is disposed of.
