JUSTICE PRAVEEN KUMAR ORAL ORDER 3 18-04-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner seeks bail in connection with Teghra (Teghrha) P.S. Case No. 373 of 2025 dated 20.11.2025, registered for the offence under Sections 111, 310(4), 310(5), 121(1), 121(2), 132, 109, 125(2) of the Bhartiya Nyaya Sanhita, 2023 and Sections 25(1-B)a, 25(1-AA), 26, 27 and 35 of the Arms Act. 3. As per the allegation, on a tip off, the informant along with police personnel reached Madhurapur Diara, whereafter the criminals started indiscriminate firing upon the police personnel. Despite being warned to surrender, the firing continued from the side of the criminals and, in self defence, the police personnel also retaliated by resorting to firing. The criminals were chased, whereupon three of them were apprehended by the police, one being the petitioner and from the possession of the petitioner, one pistol and three live cartridges were recovered. 4. Learned counsel appearing for the petitioner submits that the petitioner was arrested in confusion as his house is nearby and the petitioner was just a bystander after the occurrence having been completed. The police personnel apprehended the petitioner thinking him to be a criminal who was a party to the occurrence even though the petitioner tried to clarify his position, which remained unheard. It has been further submitted that none of the police personnel received any sort of injury in the said occurrence.
The search and seizure is in violation of Section 103 of the BNSS and the petitioner is in custody since 21.11.2025, charge-sheet has been submitted and there is no allegation of tampering.
