JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused Nos.1 to 3 in Crime No.124/2026 registered by Siddapura Police Station, Bengaluru for the offences punishable under Sections 126(2), 115(2), 118(1), 109(1) read with Section 3(5) of BNS, 2023, are before this Court - 3 - HC-KAR CNR: KAHC010540422026 NC: 2026:KHC:49393 CRL.P No. 11873 of 2026 in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.124/2026 was registered by Siddapura Police Station, Bengaluru, for the offences punishable under Sections 109(1), 118(1) read with Section 3(5) of BNS, 2023, against Sadiq and others, based on the first information dated 03.06.2026 received from Sayed Waseem, who is one of the injured victims in the present case. During the course of investigation, the petitioners herein were arrested on 06.06.2026 and remanded to judicial custody. Their bail application filed before the jurisdictional Sessions Court in Crl.Misc.5616/2026 was rejected on 23.06.2026. Therefore, they are before this Court. 4. Learned counsel for the petitioners submits that the petitioners do not have any criminal antecedents and have been in custody for the last three months. - 4 - HC-KAR CNR: KAHC010540422026 NC: 2026:KHC:49393 CRL.P No. 11873 of 2026 Investigation of the case is already completed. Accused No.4 has been enlarged on bail by this Court. Accordingly, prays to allow the petition. 5. Per contra, learned High Court Government Pleader has opposed the bail application and submits that the injured victim has suffered grievous injury in the incident in question. Accordingly, he prays to dismiss the petition. 6. A reading of the first information dated 03.06.2026 would indicate that on 02.06.2026 at about 8 p.m., when the first informant Sayed Waseem (CW1) and his friend Zameer (CW2) were walking on the roadside, they found accused No.1 and one Amjad quarrelling with each other. CW1, therefore, tried to intervene and therefore accused No.1 assaulted him. CW1, in turn, also assaulted accused No.1 - Sadiq and therefore, accused No.1 had vengeance against CW1. At about 2.30 a.m. on 03.06.2026, accused No.1 - Sadiq, along with the other - 5 - HC-KAR CNR: KAHC010540422026 NC: 2026:KHC:49393 CRL.P No. 11873 of 2026 accused persons, who are his friends, confronted CW1 and CW2 and after abusing CW1, they assaulted them. The allegation of assaulting the injured victim with a knife is found against accused No.2 - Saif. Investigation of the case is completed and chargesheet is filed. The injured victim, who had suffered grievous injury, is already discharged from hospital and his condition is stable. It is not in dispute that petitioners herein do not have any criminal antecedents. Accused No.4 has been granted regular bail by this Court in Crl.P.No.10683/2026. Under the circumstances, the following: O R D E R (i) The Criminal Petition is allowed. The petitioners are directed to be enlarged on bail in Crime No.124 of 2026 registered by Siddapura Police Station, Bengaluru, for the offences punishable under Section 109(1), 118(1), 115(2), 126(2), 117(2) read with Section 3(5) of the BNS, 2023, subject to the following conditions: - 6 - HC-KAR CNR: KAHC010540422026 NC: 2026:KHC:49393 CRL.P No. 11873 of 2026 a) The petitioners shall execute personal bond for a sum of Rs.1,00,000/- each with two sureties, out of which, one shall be local surety, for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
