Leave to amend the name of the Applicant as “Parmar Dharmendra Dineshbhai”. 2. Present Petition is preferred by the Petitioner (Original Accused) under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, seeking quashing of FIR No. 11215039250277 of 2025 registered with Virsad Police Station, Anand for the offences punishable under Section 137(2) of the Bharatiya Nyaya Sanhita, 2023. 3. Heard learned Advocate for the Petitioner and learned APP for the Respondent – State. Learned Advocate Mr. Dipesh D. Soni appears and states that he has received instructions to appear on behalf of Respondent No. 3 and he would be filing his appearance during the course of the day. Registry to accept the Vakalatnama. 4. Rule. Learned APP waives service of notice for and on behalf of the respondent – State and learned Advocate Mr. Soni waives service of R/CR.MA/314/2026(GJHC240006342026) ORDER DATED: 22/09/2026 Rule on behalf of Respondent No.3. Though served, nobody appeared for Respondent No.2 – Original Complainant. 5. Learned Advocate for the Petitioner has submitted that the matter has been amicably settled between the parties and they are now not willing to proceed with the complaint any further. 6. Learned Advocate appearing on behalf victim has placed on record the Affidavit dated 5.01.2026 stating therein that she has performed marriage with the present Applicant after she has attained the marriageable age and presently she is living with the Applicant as his wife. He submitted that matter has been amicably settled between the parties and there is no objection if present Petition is allowed. The victim is present before the court and is identified by her Advocate. 6. Considering averments made in the Affidavit as also the submissions made by the learned Advocates for the respective parties, the present Application deserves to be allowed and is hereby allowed. The F.I.R. 11215039250277 of 2025 registered with Virsad Police Station, Anand for the offences punishable under Section 137(2) of the Bharatiya Nyaya Sanhita, 2023 is hereby quashed and set aside qua the present Petitioner.
