GP FOR ENERGY The Court made the following: 3 THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO: 17252/2026 ORDER:- This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:- “to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd Respondent in trying to demolish the trees situated in petitioner’s agriculture land to an extent of Ac.0.77cents in Survey No. 103-6, Kontheru Village situated by the side of Palakollu to Doddipatia Road, West Godavari District, Andhra Pradesh under the guise of laying Electricity line through his land without any manner of right and without following the due process of law and without issuing any notice for their proposed action as highly illegal, arbitrary, exercise of power, violative of principles of natural justice and also violative of Art.19, 21 and 300-A of the Constitution of India and consequently direct the 3rd Respondent not to demolish the trees situated in petitioner’s agriculture land an extent of Ac.0.77cents in Survey No.103-6, Kontheru Village situated by the side of Palakollu to Doddipatia Road, West Godavari District, Andhra Pradesh and pass such other order or orders….” 2. Heard learned counsel for the petitioner and learned Standing Counsel for the respondents. 3. Learned counsel for the petitioner submits that the petitioner herein is the absolute owner and possessor of the agricultural land admeasuring to an extent of Ac.0.77 cents in Sy.No.103-6, Kontheru Village, West Godavari District, having acquired the same through a settlement deed. Since then, the petitioner has been in possession and enjoyment of the said property by growing coconut trees and other plantations in the said land. The electricity department has provided power supply to the said premises. For which, the 4 petitioner has been paying the electricity charges regularly without any default. While things stood thus, the respondent authorities along with their staff are trying to interfere with the possession of the petitioner’s agricultural land and trying to cut the trees on the guise of laying electricity lines through the said land, without issuing any notice and without following due process of law. Hence, the Writ Petition. 4. On the other hand, learned Standing Counsel submits that if the respondents intend to demolish/cut down the trees or to interfere with the petitioner’s peaceful possession, they will follow due process of law. 5. Having regard to the submissions made by both the learned counsel and on perusal of the material placed on record, this Court is of the considered view that the present Writ Petition can be disposed of, directing the respondents not to demolish/cut down the trees situated at the petitioner’s subject land on the guise of laying the electrical lines without following due process of law. If at all the respondents intend to lay any electricity lines through the petitioner’s property, more particularly, by cutting the trees of the petitioner, they shall follow due process of law. 6. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. 7.
