CRM (M) 202 of 2026
In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Jangipur Cyber Crime Police Station case no. 05 of 2025 dated 22.01.2025 under Sections 316(2)/318(4) of the Bharatiya Nyaya Sanhita, 2023.
And In the matter of : Debasish Mallick
……Petitioner. Mr. Debapratim Guha Mr. Sudip Biswas
……for the Petitioner. Ms. Anasuya Sinha, Ld. APP Mr. Kunal Ganguly
……for the State.
Learned advocate appearing for the petitioner submits that petitioner is in custody for about one year eleven days and is innocent of the charges. There has been allegedly a sum of Rs.42,000/- for which the petitioner has been implicated in connection with the instant case. On the other hand learned advocate for the State opposes the prayer for bail and submits that date has been fixed for consideration of charges. The foundational facts also relate to providing job for which a Whatsapp group was opened, and commitments were made in lieu of money. Be that as it may, so far as the facts of the case are concerned there are certain victims who have suffered financial loss. Accordingly, having regard to the stage of the case, I direct the petitioner to renew his prayer for bail after the evidence of the victim is over.
2 Learned trail Court would give priority to the evidence of the victim as the first few witnesses in the instant case. At this stage, CRM (M) 202 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
