Learned advocate for the petitioner submits that the petitioner is in custody since 13th June, 2025; charge-sheet has been submitted and charges have been framed. However, the evidence of the victim according to the petitioner, is unnecessarily being stretched at the behest of the prosecution. Learned advocate for the State opposes the prayer for bail. I have taken into account the reasons for the earlier rejection of bail and I am of the opinion that until and unless the evidence of the victim is complete, it would not be fit and proper to release the petitioner bail.
2 Hence, the prayer for bail of the petitioner is Rejected. The victim is on dock and it has been submitted that on number of dates, her examination-in-chief has been done, as such, I direct the learned Special Court that by 15th October, 2026, the evidence of the victim be completed. To that effect, the learned trial court would fix as many dates as possible. No unnecessary adjournment be granted to any of the parties and the trial of the case would continue inspite of any resolution of the local bar. The petitioner would be at liberty to renew his prayer for bail after the evidence of the victim is over. Accordingly, CRM (M) 1791 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
