1. WPC No.1947 of 2021 has been filed against the contempt proceeding initiated by the Board of Revenue against the present petitioner on the ground that he made willful disobedience of the Court's order dated 26.03.2018 passed by the Board of Revenue in Revision Case No. RN-06/RB- 121/116/2018 (Jagdish Prasad Bansal - Versus State of Chhattisgarh), whereby the Board of Revenue has passed a stay order in favour of respondent No. 2 and though there is a stay order, but, willfully neglecting the
order of the Board of Revenue, the petitioner has demolished the structure of respondent No. 2 and for that disobedience of the Court's order, respondent No. 2 filed a contempt petition under Section 12 of the Contempt of Courts Act, 1971 before the Board of Revenue. Challenge is also on the ground that the Board of Revenue has no jurisdiction under Section 12 of the Contempt of Courts Act, 1971 to initiate contempt proceeding against the petitioner and it is admitted fact that in all the proceedings which were initiated from the Court of Tahsildar to the Board of Revenue, the present petitioner was not a party.
2. WPC No.2718 of 2021 has been filed being aggrieved by the order dated 17.06.2021 (ANNEXURE P/1) passed by the Board of Revenue/respondent no.1 against the present petitioner in Case No. M/06/R/B-121/25/2019 (JagdishBansal vs. Shivkumar Dansena and Ors.), whereby the respondent No. 1 has in violation and contrary to the order dated 08.06.2021 passed by this Court in WP(C) NO.1947/2021 (Indrajeet Burman vs. The Board of Revenue and Ors.) and also contrary to the materials and proceedings of the Case no. M/06/R/B-121/25/2019 passed the impugned order constituting the committee to enquire about the allegation against the petitioner as well as the direction is issued to the General Administration Department to make
3 endorsement in the annual credential report (ACR) of the petitioner regarding non-compliance of the court order and non-performance of the duties.
3. At the outset, counsel for the petitioners in unison submits that subsequently final order dated 20.05.2026 has been filed by the Board of Revenue in Revenue Case No.M/06/R/B-121/25/2019 and as such, both these writ petitions become infructuous. However, they pray for a liberty to approach appropriate forum in this regard.
4. Accordingly, both the writ petitions are dismissed as having been rendered infructuous with liberty as prayed for.
