The petitioner is before this Court challenging the order dated 30.12.2025 passed by the II Additional Senior Civil Judge and JMFC, Kolar, in C.C. No.598/2025 and seeking to quash the proceedings in the said case. 3. Learned counsel appearing for the petitioner would submit that the complainant has cheated the petitioner and the transaction which is covered in the complaint is not a real transaction, but a concocted story. 4. However, learned counsel for the petitioner would submit that, the cheque in question, which is dishonoured, pertains to the petitioner. It is made clear that the observations made in this order are confined only to the consideration of the petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, and not on the merits of the defence raised by the petitioner.
