Mr. Amajit De. …for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 7 years 2 months and the petitioner is better placed than two of the accused persons who have been granted bail. Learned advocate for the State opposes the prayer for bail and submits that out of 16 witnesses proposed to be examined, 14 witnesses have been examined. Records reflect that the petitioner is in custody for 7 years 2 months. The foundation on which bail was granted in respect of some of the accused persons relate to the statement under Section 164 of the Cr.P.C of a minor. So far as the said statement is concerned, I am of the opinion that petitioner is better 2 placed than the other accused persons who have been granted bail. Having regard to the same, I am of the opinion that petitioner be released on bail. As such, the prayer for bail of the petitioner is allowed. The petitioner, namely, Rabi Das shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Additional Sessions Judge, Chanchal, Malda. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Malda without prior permission of the learned trial court. Thus, CRM(M)976 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
