Affidavit of service filed be kept with the record. Learned advocate for the petitioner submits that the evidence which has been deposed before the learned trial court fails to make out any case so far as the present petitioner is concerned. The primary witnesses on whom the prosecution relies upon has failed to identify the petitioner, as such, no case has been made out. Learned advocate emphasizes that FSL report till date has not been placed before the learned trial court and because of non-production of the materials, the case has been delayed and the petitioner is in custody for three years seven months. Learned advocate for the State submits that the evidence of the Investigating Officer is in progress.
2 Having considered the advance stage of the case including the materials available in the case diary as also the foundational facts which are reflecting in the case diary, at this stage, without further elaborating on the evidence, at this stage, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. However, the learned trial court would pronounce the verdict by 31st of December, 2026. Accordingly, CRM (M) 1787 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Learned advocate for the State will communicate this order to the learned trial court at the earliest. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
