ORAL ORDER
1. Petitioners who are apprehending arrest in Crime No.411 of 2026 registered by Peenya Police Station, Bengaluru City for offence punishable under Section 318(4) of BNS, 2023 are before this Court in this petition filed under Section 483 of BNS, 2023 seeking anticipatory bail.
2. Heard the learned counsel for the parties.
3. FIR in Crime No.411 of 2026 was registered by Peenya Police Station, Bengaluru City for the aforesaid offence against one Nagesh and others, based on the first information dated 28.07.2026 received from Sri Jagadish S S/o Subramani. Apprehending arrest in the said case, the petitioner had filed Crl.Misc.No.7912 of 2026 which was dismissed on 10.08.2026

by the jurisdictional Sessions Court. Therefore, they are before this Court.
4. Petitioner no.1 is the Branch Manager and petitioner no.2 is the Zonal Credit Manager of IndusInd Bank, Peenya Branch, Bengaluru. In the first information which is submitted by Jagadish S, it is stated that, on 23.07.2026, his friends had introduced Nagesh to him who was in need of financial assistance. Nagesh allegedly had represented to Jagadish that he had availed loan of Rs.1,50,00,000/- from IndusInd Bank by pledging gold ornaments and since he was not in a position to pay the monthly instalment, he intended to repay the entire loan amount to IndusInd Bank and redeem his gold jewelry. The first informant therefore, totally transferred amount of Rs.1,53,00,000/- to the bank account of Nagesh and thereafter, Nagesh started evading him. On enquiry, the first informant was informed that the gold ornaments pledged by Nagesh in IndusInd Bank were all spurious. It is under these circumstances, the first informant had approached the police.

5. It appears that during the course of investigation, the petitioners herein were summoned to police station and were made to sit in the police station. It is under these circumstances, petitioners had approached this Court in W.P.No.24434 of 2026 with a prayer to quash the enquiry notice issued to the petitioners under Section 35(3) of BNSS,
2023. In the said case, the Co-ordinate bench of this Court had
directed the investigation officer to appear before the Court in person. It appears that after the investigation officer had appeared in person before this Court, a submission was made by the learned State Public Prosecutor that the case is now handed over to Criminal Investigation Department and the further investigation shall be done by the said investigating agency.
6. It is not in dispute that pursuant to the enquiry notices issued to them, the petitioners had appeared before the police earlier. They are officials working in a bank occupying high posts. They do not have any criminal antecedents and they have undertaken to co-operate with the police for the

purpose of investigation. Under the circumstances, the following:-
ORDER (i) The Criminal Petition is allowed. (ii) The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.411 of 2026 registered by Peenya Police Station, Bengaluru City for offence punishable under Section 318(4) of BNS, 2023, subject to the following conditions:
1. The petitioners shall appear before the Investigating Officer in the present case within a period of fifteen days from the date of receipt of certified copy of this order on executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) each with two sureties for the likesum to the satisfaction of the investigating officer/jurisdictional Court.
2. The petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons.

3. The petitioners shall not tamper with the prosecution witness and they shall co-operate with the Police for investigation and appear before them whenever called upon.
4. The petitioners shall not involve in similar offences in future.
