Mr. Pinaki Bhattacharyya. …for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 2 years. The vulnerable witnesses have already been examined by the prosecution. However, there are number of witnesses yet to be examined by the prosecution, as such, the petitioner be released on bail. Learned advocate for the State opposes the prayer for bail and submits that there was manual smothering in the present case. There were other injuries. Evidence of the minor points to the guilt of the present petitioner. I have taken into account the overall materials and the further time which will be required to take the trial to its logical conclusion. Having considered the same, I am of the view that further detention of the present petitioner may not be warranted. As 2 such, the prayer for bail of the petitioner is allowed. The petitioner, namely, Goutam Malik shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned CJM, Chinsurah, Hooghly. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Hooghly without prior permission of the learned trial court. Thus, CRM(M)1060 of 2026 is allowed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
