Earlier, the bail applications of the petitioners on several occasions were rejected. So far as the stage of the case is concerned, the evidence of the witnesses is over and the examination under Section 313 of the Cr.P.C. is complete, thereafter, for want of sanction, one witness was examined by the prosecution. Consequently, the defence evidence is in progress at this stage. Having considered the stage of the case and the fact that the defence is examining its witnesses, as such, the 2 delay cannot be attributed to the prosecution, so I am of the opinion that the petitioners cannot be enlarged on bail Hence, the prayer for bail of the petitioners is Rejected. Accordingly, CRM (M) 1792 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record.
