A case is made out in this writ petition that in spite of filing an application under Section 175(3) of BNSS, 2023, concerned police authorities could not be activated by filing report resultantly adjudication process is being delayed unnecessarily. 2. Mr. Ray, learned Government Pleader representing State respondents disputes such submission made on behalf of petitioner and it is submitted that report was submitted before the jurisdictional Magistrate recorded in order dated 26th August, 2025 passed on writ petition being WPA 29370 of 2024 preferred by petitioner. 3. Learned advocate representing respondent nos.7 & 8 has opposed this writ petition on the strength of order dated 26th August, 2025 passed on WPA 29370 of 2024. 4. This Court has perused order dated 26th August, 2025 passed by the coordinate Bench on WPA 29370 of 2024 since copy of this order is placed before this Court and same is taken on record. 5. It appears that it was recorded in said order that report dated 22nd August, 2025 was submitted before the jurisdictional Magistrate in connection with application made by petitioner under Section 175(3) of BNSS, 2023. It is also recorded in said order that application under Section 175(3) of BNSS, 2023 was pending and petitioner did not appear before court below on fixed dates. 6. Since previous writ petition being WPA 29370 of 2024 was dismissed by coordinate Bench vide order dated 26th August, 2025 and issue precisely remain same in the present writ petition, no order ought to be passed which will revive said issue. 7.
