1) In terms of order dated 21st August, 2026 writ petition is taken up for consideration when learned advocates representing parties have jointly placed before this Court order of the Hon’ble Division Bench dated 1st September, 2026 passed on an intra court appeal being MAT 1443 of 2026 (Riziya Bibi & Ors. Vs. Firoz Khan & Ors.). A copy of said order is taken on record. 2) On perusal of order of the Hon’ble Division Bench dated 1st September, 2026, it appears that Hon’ble Division Bench while dismissing intra court appeal did
2 not interfere with the order passed by this Court on 21st August, 2026. 3) Learned advocate representing State respondents has filed a communication dated 2nd September, 2026 of Inspector-in-Charge of Panskura Police Station, Purba Medinipur enclosing declaration dated 2nd September, 2026 of petitioner and same is taken on record. Copies of communication dated 2nd September, 2026 are made over to learned advocates representing petitioner and respondent nos. 5 to 9. 4) It is disclosed in communication dated 2nd September, 2026 that in terms of order dated 21st August, 2026 steps were taken by concerned police authorities and consequently shop of petitioner was opened on 2nd September, 2026. 5) Learned advocate representing petitioner on instruction submits that at present petitioner is running his business by keeping open his shop. 6) In view of steps taken by concerned police authorities, no further order need be passed on this writ petition and writ petition is disposed of. 7) However, police authorities are directed to extend assistance to petitioner, if occasion so arises. 8) This order shall not preclude respondent nos. 5 to 9 to take steps in accordance with law, if so advised. 9) Parties to act on server copy of this order duly downloaded from the official website of this Court.
