In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Lalgola Police Station Case No.272 of 2026 dated 06.04.2026 under Sections 85/80(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 read with Sections 3/4 of the Dowry Prohibition Act;
Pran Kumar Ghosh @ Pran Ghosh @ Pan Ghosh & Ors. Versus The State of West Bengal
Mr. Tapodip Gupta Ms. Usashi Chattopadhyay Mr. Golam Ahammed. …for the petitioners. Mr. Gouranga Kumar Das Mr. Bhaskar Seth Ms. Priyanka Bhattacharya. …for the State. Mr. Arindam Chattopadhyay Ms. Lipika Chatterjee Mr. Soumik Dey Ms. Rina Das. …for the de facto complainant. Petitioners are the father-in-law, mother-in-law and brother-in-law who have been implicated in the present case. Learned advocate for the petitioners submits that they are innocent and the husband has already been arrested and has been taken into custody. Learned advocate for the State has opposed the prayer for anticipatory bail and submitted the case diary. Learned advocate for the de facto complainant also
2 opposes the prayer for anticipatory bail. I have taken into account the complicity of the three petitioners. However, only considering that the petitioner no.2 is a lady, I am inclined to grant the anticipatory bail to the petitioner no.2, namely, Pratima Ghosh @ Protima Ghosh. As such, the prayer for anticipatory bail of the petitioner no.2 is allowed. So far as the petitioner nos.1 and 3 are concerned, their prayer for anticipatory bail is rejected. Accordingly, in the event of arrest, the petitioner no.2, namely, Pratima Ghosh @ Protima Ghosh shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge-sheet has already been submitted before the jurisdictional court, this order of anticipatory bail of the petitioner no.2 will remain in force for a period of six weeks from date. Accordingly, CRM(A) 2931 of 2026 is partly allowed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
