3. The present first Bail Application has been moved by Applicant-Maruf@Waseem aged about 30 years, S/o Saleem Ahmad, R/o Chappar Wali Masjid, Khatari, Ramnagar, District Nainital. The Applicant is in judicial custody in connection with FIR No.0237 of 2025 dated 24.06.2025, registered at Police Station Ramnagar, District Nainital, under Sections 109, 115, 190, 191(2), 191(3), 351(2) and 352 of B.N.S., 2023.
4. Heard Mr. Deepak Chandra, learned counsel for applicant and Mr. Pankaj Joshi, learned A.G.A. for the State and perused the record.

Learned counsel for Applicant submits that the Applicant has falsely been implicated in the instant crime and he is an innocent person. It is further submitted that applicant is not named in FIR and there is delay of 11 days in lodging the FIR. It is also submitted that the medical report of injured reveals that there is no injury which could be said to be dangerous to life.
6. It is further contended that co-accused persons namely Saurabh Singh and Yogendra Kumar have already been granted bail vide
order dated 20.11.2025 and 28.11.2025
2026:UHC:564 respectively, thus, the applicant is also entitled to be released on bail on the basis of parity.
7. Learned State Counsel fairly admitted that it is a case of parity.
8. Considering facts and circumstances of the case and without expressing any opinion on the merits of the matter, this Court is of the view that the Applicant deserves to be released on bail at this stage.
9. Accordingly, the first bail application is allowed.
10. Let the Applicant- Maruf@Waseem, be released on bail on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of Court concerned.

disposed of.
