Hon’ble Shri Justice Rakesh Mohan Pandey Order on Board 08/10/2026
1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 171/2026 registered at Police Station Punjipathra, District Raigarh (C.G.) for offences punishable under Sections 309(6) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 2. Case of the prosecution, in brief, is that on 13.07.2026, the complainant- Kuber Kumar Yadav lodged a written report alleging that at around 4:30 PM, while he was walking towards village Tumidih market, three persons riding a motorcycle intercepted him near the company gate, surrounded him, and demanded his mobile phone and
2 purse. Upon his refusal, one of the assailants stabbed him near his stomach with a sharp-edged knife, causing bleeding injuries, and the accused persons looted his Vivo T3 mobile phone valued at 11,000/- ₹
along with his purse containing cash, and fled from the spot. On the basis of the said complaint, the present crime was registered. 3. Learned counsel for the applicant submits that the applicant is innocent and has falsely been implicated in the crime. It is submitted that the specific role of assaulting the victim with a knife is attributed to co- accused Jagannath, from whose memorandum the weapon of offence (knife) was recovered, while the looted mobile phone was seized from co-accused Kuldeep. It is further submitted that the investigation is complete and the charge-sheet has already been filed, the applicant has no previous criminal antecedents, he is languishing in jail since 14.07.2026, and conclusion of the trial will take considerable time; thus, the applicant may be enlarged on regular bail. 4.
On the other hand, learned State counsel opposes the bail application and submitted that the applicant along with other co-accused persons, committed robbery and inflicted knife injuries on the victim, and looking to the gravity of the offence, the applicant may not be enlarged on bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case, the nature of allegations, and particularly the role attributed to the present applicant; further considering that the specific allegation of stabbing is against co-accused Jagannath from whom the knife was seized, and the looted mobile phone was recovered from co-accused Kuldeep; further, the investigation has been completed and the charge-sheet has already been filed; applicant has no criminal antecedents, he is in jail since 14.07.2026, and conclusion of the trial is likely to take some time, this
3 Court, without commenting upon the merits of the case, is inclined to release the applicant on bail. Accordingly, the application is allowed. 7. It is directed that in the event of the applicant executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, he shall be released on bail, on following conditions :- (i) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court, (ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, and (iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. 8. The observation made hereinabove is for the purpose of deciding this bail application only, the trial Court shall decide the case on its own merits. Sd/-
