Aminul Islam …for the private respondent Affidavit of service filed by the petitioners is taken on record. The petitioner alleges that the private respondents are raising unauthorized construction in two plots of land one of which is recorded as ‘Pukur’, without conversion of the same and without obtaining sanction from the concerned Panchayat. Learned counsel for the private respondent produces sanctioned building plan as well as conversion certificate which demonstrate that the plot recorded as ‘Pukur’ has been converted prior to grant of the sanctioned building plan. The allegation of the petitioner is devoid of merit. The writ petition is, therefore, dismissed. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
