Affidavit of service filed on behalf of the petitioner is taken on record. The petitioner is represented. The respondent no. 2 represented. The respondent nos. 1, 3 and 4 are also represented. Learned Advocate for the petitioner submits that the petitioner filed this present writ petition praying for an order to dispose of the second appeal dated October 29, 2025, being diary No. 101561 of 2025 which has been filed by the petitioner before the respondent no. 2 Authority. Learned Advocate representing the respondent no. 2 Authority submits that no second appeal has been filed before the respondent no. 2. He submits that what has been filed by the petitioner by a document dated October 29, 2025 is a complaint under Section 18 of the Right to Information Act,
2005.
2 Accordingly, he submits that the prayers in the writ petition cannot be considered and the same should be dismissed. At this juncture, learned Advocate representing the petitioner submits that he is desirous of withdrawing the writ petition with liberty to file an appeal against an order dated October 9, 2025, passed by the First Appellate Authority and Secretary, Finance Department, Government of West Bengal. In view of the aforesaid submission, this writ petition is dismissed as withdrawn with liberty being granted to the petitioner to file an appropriate appeal against the aforesaid order dated October 9, 2025. The respondent no. 2 Authority is directed to dispose of the same, if filed, within a reasonable period of time and in accordance with law. Since no affidavits are called for, the allegations made in the writ petition are deemed not to be admitted by the respondents. Accordingly, this writ petition stands dismissed as withdrawn. There will be no order as to costs. All parties shall act on the server copy of this order, duly downloaded from the official website of this Court Urgent certified photocopy of this order, if applied for, be supplied to the parties upon compliance of necessary formalities.
