Matter is accommodated in today’s list under the heading “To Be Mentioned” for release since it was mentioned by learned advocate representing petitioner that in view of urgency matter needs to be accommodated in the Supplementary List. At the time of mentioning, this Court was not satisfied with urgency pleaded and directed the matter to appear under the heading “To Be Mentioned” for release. 2. Today submissions are made by learned advocate representing petitioner who appears on virtual mode and learned advocates representing Union of India and Central Bureau of Investigation (CBI). 3. Having heard the matter on merit it appears that matter can be disposed of without releasing the same as prayed for on behalf of petitioner while mentioning the matter. 4. From the submissions made on behalf of parties who are being represented by learned advocates, it appears that there are three criminal prosecutions which were initiated based on complaint lodged by
[2] petitioner – (i) Deganga P.S. Case no.581/ 2024 dated 3rd October, 2024, (ii) Deganga P.S. Case no.605/ 2025, (iii) Deganga P.S. Case no.17/ 2026 dated 12th January, 2026. 5. By presenting this writ petition, petitioner prays for direction upon the concerned police authority to provide protection and prayer is also made which would facilitate demarcation of plots of land in question. 6. However, it is submitted on behalf of respondent authorities that investigation in Deganga P.S. Case no.581/ 2024 dated 3rd October, 2024 and Deganga P.S. Case no.605/ 2025 was completed and charge- sheets dated 30th October, 2024 and 31st December, 2025 were filed respectively before the jurisdictional Magistrate. Therefore, in connection with these two criminal prosecutions where charge-sheets have been filed, no order need be passed. 7. However, it further appears that another FIR was registered being Deganga P.S. Case no.17/ 2026 dated 12th January, 2026 as it is disclosed in paragraph 14 of the writ petition. 8.
Concerned police authorities are directed to take necessary steps in connection with Deganga P.S. Case no.17/ 2026 for taking the investigation to its logical conclusion. Police authority is not the appropriate authority to demarcate plots of land in question. 9. However, concerned police authorities are directed to maintain peace and tranquility at the locale and to see that no untoward incident takes place. [3]
