Learned advocate for the petitioners submits that the petitioner no.1 is the father-in-law, petitioner no.2 is the mother-in- law and petitioner no.3 sister-in-law who have been implicated in the present case. It has been contended that the incident occurred at the parental house of the deceased where she and her husband were sleeping in a room. Learned advocate claims innocence of the present petitioners and, as such, pray for anticipatory bail. State has opposed the prayer for anticipatory bail. I have taken into account the statement of the witnesses. Prima facie, the petitioners’ contention in the materials appearing from the case diary are substantiating that the incident occurred at the parental house of the deceased although there are accusations
2 relating to demand of dowry. Be that as it may, having considered the overall circumstances of the case particularly the place at which the incident took place, I am of the view that custodial detention of the present petitioners may not be warranted. As such, the prayer for anticipatory bail of the petitioners are allowed. Accordingly, in the event of arrest, the petitioners, namely, Mahabul Sk., Golenur Bibi @ Beli Bibi and Sahinur Khatun shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge-sheet has already been submitted before the jurisdictional court, this order of anticipatory bail will remain in force for a period of six weeks from date. Accordingly, CRM(A) 2932 of 2026 is allowed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
