….for the State. Learned advocate appearing for the petitioner submits that another accused has been granted bail by the Hon’ble Supreme court in Special Leave to Appeal (Crl.) No. 16546/2025. Present petitioner according to the learned advocate is similarly situated. Be that as it may, I have taken into account the locus of the present petitioner from whom there has been recovery and was identified in the T.I. Parade. The basic accusation is that the present petitioner along with others impersonated themselves. So far as the present petitioner is concerned, he impersonated himself to be a CBI Officer. Totality of the
2 circumstances reflects that the accused who has been granted bail acted under the leadership of the present petitioner. Be that as it may, having considered that the petitioner is in custody for 3 years 8 months and prosecution intends to examine in total 40 witnesses and till date only 14 witnesses have been examined, I am of the view that on the anvil of period of incarceration, petitioner and the other accused who has been granted bail are similarly situated. Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely Rakesh Mondal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned CJM, Alipore. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Kolkata and South 24 Parganas without prior permission of the learned Trial Court. Memo of Evidence submitted be kept with the record. Accordingly, CRM (M) 1798 of 2026 is allowed.
