The petitioner is apprehending his arrest in connection with Kandi P.S. Case No. 121 of 2025, registered for the offence under Sections 82(1), 352, 85 and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Garhwa. 3. Learned counsel appearing for the petitioner submits that the petitioner happened to be the husband of the informant and false allegations are made that this petitioner is having the relationship with another lady. He next submits that however, that allegation is not correct, as the wife of this petitioner herself is not residing with this petitioner and not taking care of their child since last three years. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the petitioner happened to be the husband of the informant. 5. Considering that it has been pointed out that the informant herself is not residing with the petitioner and further not looking after their children since last three years and in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
