JUSTICE PRANAV TRIVEDI Date : 25/09/2026 ORAL ORDER 1 Heard Mr.Kaash Thakkar, learned advocate for the petitioner, Mr.Shivam Parikh, learned Assistant Government Pleader for the state respondents and learned advocate Ms.Archana Acharya for respondent Nos. 3 to 6. 2 The present petition is preferred praying for a direction to the respondent – Gram Panchayat to remove the illegal encroachment done by 37 persons. 3 By way of order dated 10.04.2026, this Court has directed the learned AGP to take instructions from the concerned DILR with regard to the time that shall be C/SCA/5137/2026(GJHC240247082026) ORDER DATED: 25/09/2026 consumed in measurement of the gauchar land and demarcation of encroachment. Pursuant to the direction of this Court, learned AGP has filed affidavit-in-reply, which states that pursuant to the representation made by the petitioner, the gram panchayat has communicated to the District Inspector of Land Records, who, inturn has initiated the process of measurement on 21.09.2026. 4 In view of such development, learned advocate Mr.Thakkar, under instructions, does not press the present writ petition and requests for withdrawal of the matter with a liberty to agitate the issue, in case of any future difficulty. 5 The request made by the learned advocate for the petitioner is acceded to.
