Learned advocate appearing for the petitioner submits that the prosecution has framed the case against the present petitioner who is a lady and the same is without any substance. Unnecessarily petitioner has been detained since September, 2025 and there is no possibility of the trial commencing in near future, as such, petitioner be released on bail.
Learned advocate for the State, on the other hand, submits that the throat of the deceased was slit. There are 11 injuries at the chest and 22 injuries at the abdomen region. It has also been submitted that the case cannot proceed because one of the accused person is absconding.
Having considered the gravity of the offence, I am not inclined to release the petitioner on bail at this stage. Petitioner will renew her prayer for bail after the stage of consideration of charges
2 are over.
So far as the learned jurisdictional court is concerned, I direct that the processes be exhausted against the absconding accused person and thereafter the case be committed to the court of sessions. Whole of the process be completed at the earliest. Learned sessions court would, within one month from the receipt of the records, overcome the stage of consideration of charges.
At this stage, CRM(M)1079 of 2026 is dismissed.
