Learned advocate for the petitioner submits that the death was accidental and because of previous grudge, the petitioner has been implicated in the instant case. The post- mortem report do not support the contention of the prosecution. Learned advocate also submits that there is nothing to suggest the complicity of the present petitioner and the petitioner is unnecessarily languishing in jail for the last one year eight months. Therefore, learned advocate prays that the petitioner may be released on bail. Learned advocate for the State opposes the prayer for bail and submits that six witnesses have already been examined.
2 The prosecution’s paper reflects that there are eyewitnesses and the eyewitnesses specifically named the present petitioner along with the others. It also reflects the overt acts and involvement of the present petitioner. Moreover, the injuries in the postmortem report do corroborate the version of the eyewitnesses and the other witnesses concerned. Having considered the prosecution’s version, at this stage, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. However, the learned trial court is directed to expedite the process of trial as already one year eight months have passed. Accordingly, CRM (M) 1795 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
