(2) Petitioner’s father was serving as Assistant Teacher in a Government Primary School, who died in harness on 31.12.2019. Petitioner applied for compassionate appointment. Since no decision has been taken on his request, therefore, he has filed this writ petition seeking the following relief: “I. A writ, order or direction in the nature of mandamus commanding the Respondents to consider the claim of Petitioner for appointment on compassionate ground against any suitable posts as per the educational qualification of the Petitioner under dying in harness rules.” (3) Learned Counsel for the petitioner submits petitioner’s mother also had to file a writ petition for family pension and pursuant to order of this Court, passed in WPSS No. 921 of 2020, family pension was released in her favour. (4) Since petitioner had applied for compassionate appointment on 6.10.2022 and more than three years have elapsed since filing of that application, therefore, writ petition is disposed of with a direction to District Education Officer (Elementary), Rudraprayag to take decision on petitioner’s application, as per law, within three weeks from the date of presentation of certified copy of this order.
