1. Affidavit-of-service filed on behalf of petitioner is taken on record.
2. By presenting this writ petition, petitioner has complained of overt action on the part of concerned police authorities in calling petitioner and insisting production of copies of credentials of petitioner and family members of petitioner which according to petitioner is not permissible in terms of statutory framework.
3. Ms. Agarwal, learned Additional Government Pleader representing State respondents has filed a communication dated 7th September, 2026 of Inspector- in-Charge, Lake Town Police Station and same is taken on record.
4. Communication dated 7th September, 2026 discloses
reasons for calling petitioner to police station for conducting preliminary enquiry based on inputs received. Furthermore this Court finds based on submission made by learned advocate representing petitioner that petitioner is being called by concerned police authorities pursuant to notice issued under Section 94 of Bharatiya Nagarik Suraksha Sanhita,
2023. Therefore, it is not a case that without notice petitioner is being compelled to attend police station. Moreover under Section 94 of BNSS, 2023 concerned police authority is empowered to take steps for the purpose of investigation and holding preliminary enquiry.
5. Hence, present writ petition is disposed of thereby permitting concerned police authorities to carry on preliminary inquiry/investigation in accordance with law and this Court expects that petitioner shall cooperate with the investigating agency.
6. If petitioner’s presence before the concerned police authority is required, appropriate notice shall be issued to petitioner thereby giving him at least 48 hours time to comply with such notice.
