In Re : Suraj @ Md. Wasim
... Petitioner. Mr. Suman Chakraborty, Mr. Rudransu Das, Ms. Monisha Joshi
... For the Petitioner. Mr. P. Karan Singh
... For the State. Report submitted by the learned advocate appearing for the State along with the acknowledgement of the private opposite party no.2/de facto complainant be kept with the record. Memo of Evidence submitted on behalf of the State be also kept with the record. Learned advocate appearing for the petitioner submits that the petitioner is in custody since 17.02.2026; charge- sheet has been submitted, charges have been framed and evidence of the victim has already been completed. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and produces the case diary. I have taken into account the statement of the victim and overall circumstances appearing in the present case. 2 Having regard to the progress of the case, I am of the opinion that no hindrance is being created in the progress of the case by the present petitioner. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Suraj @ Md. Wasim shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Chandernagore, Hooghly. If on bail, the petitioner shall be physically present on each and every date before the learned Special Court and shall not leave the jurisdiction of the district of Hooghly without prior permission of the learned Special Court. Additionally, the petitioner shall not enter the jurisdiction of Bhadreswar Police Station till the evidence of rest of the relatives and local witnesses is over. Learned Special Court would, at the relevant point of time, reconsider the issue of the petitioner entering the jurisdiction of Bhadreswar Police Station. The application for bail, being CRM (M) 901 of 2026, is, thus, disposed of.
