The instant bail application has been preferred by the petitioners for grant of regular bail for the offences registered under Sections 103(1), 3(5) of the BNS in connection with Pakuria PS Case No. 34 of 2025 pending in the Court of Judicial Magistrate, 1st Class, Pakur. 3. Learned senior counsel for the petitioners submits that the petitioners are innocent and have not committed any offence. It is submitted that in this case, FIR has been lodged after four days of occurrence and on the facts alleged no offence under Section 103(1) of BNS is made out as there was no premeditation or intention to kill. Learned senior counsel further submits that the petitioners do not have criminal antecedent and they are languishing in judicial custody since 02.12.2025 as such the petitioners may be enlarged on bail. 4. Learned APP opposes the prayer for bail of the petitioners. 5. Having regard to the gravity of the offence and the allegation made against the petitioners, I am not inclined to enlarge the petitioners on bail and accordingly, the prayer for bail of the petitioners 2026:JHHC:8572 2 is rejected, at this stage.
