Learned Senior Advocate appearing for the petitioner submits that petitioner is in custody for more than 9 months. Charge sheet has already been submitted before the jurisdictional Court and the prosecution case is based upon demand of dowry, prohibition of child marriage act as well as under the POCSO Act.
Learned advocate for the defacto complainant opposes the prayer for bail.

State has produced the case diary, referred to the post- mortem report as well as the statement of the father of the deceased under Section 183 of the BNSS.
I have taken into account the overall materials appearing in the case diary. Without entering into the merits of the case, I am of the opinion that further detention of the present petitioner for further progress of the case is unwarranted.
As such, prayer for bail of the petitioner is allowed. Accordingly, Petitioner shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, Special Court (POCSO), Lalbagh, Murshidabad. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Murshidabad without the prior permission of the learned Trial Court.
Accordingly, CRM (M) 1797 of 2026 is allowed.
