The learned counsel for respondent No.2 would submit that already the Trial Court has recorded the evidence of the witnesses and only yet to give a finding on the evidence available on record. 4. When such being the case, the question of continuing these proceedings does not arise and the very request of the learned counsel for respondent No.2 that he would get the instructions also does not arise when the trial has already been commenced and completed.
