Mr. Pradip Chatterjee Ms. Srishti Sarkar … For the petitioner. Ms. Supriya Singh … For the State. 1. Affidavit of service filed in Court is taken on record. 2. The instant writ petition has been filed, inter alia, praying for a direction upon the respondents, particularly the Block Development Officer, to immediately release and disburse the admitted outstanding due amount of Rs.9,20,270/- in favour of the petitioner. 3. The petitioner claims to have participated in a Notice Inviting Tender regarding repair and or renovation work of 09 nos. of primary school for reopening of school at different sites under Gadhearkuthi Gram Panchayat within Dhupguri Development Block. 4. The petitioner having become successful, a work order was issued on 8th February, 2022. The petitioner claims to have completed the work and in this regard the petitioner places reliance on the details of cases of ICW reopening of schools after Covid, wherein the Block 2 WPA 1665 of 2026 Development Officer has recorded in the remarks column that the work has been completed. According to the petitioner although the final bill has been raised and a request was made for disbursal of final payment, no payment has been made till date. 5. Ms. Singh, learned advocate appearing for the State by placing before this Court the communication dated 17th August, 2026, issued by the Block Development Officer, Dhupguri, Jalpaiguri, would submit that the work has been completed by the petitioner and the requisition bill has also been submitted. According to such communication, the dues could not be released for want of funds, as such, prayer for release of funds has already been sent to the district authorities vide memo dated 27th February, 2026. The said requisition for disbursal of funds has also been enclosed. 6. Copy of the aforesaid communication as placed before this Court is taken on record. 7. Having heard the learned advocates appearing for the respective parties and taking note of the fact that the work has been duly executed by the petitioner, I am of the view that the admitted dues of the petitioner cannot be held back for want of fund at the end of the Block Development Office. 8. In the peculiar facts, I direct the Secretary, Finance Department to look into the matter and ensure disbursal of funds in favour of the respondent no.4, for payment of the admitted dues in favour of the petitioner. 3 WPA 1665 of 2026 9. It is expected that the admitted dues as payable to the petitioner shall be disbursed within a period of four weeks from the date of communication of this order. 10. With the above observations and directions, the writ petition is disposed of.
