V I.E APPLICATION DATED 31.03.2022 FILED UNDER ORDER 6 RULE 17 READ WITH SECTION 151 OF THE CODE OF CIVIL PROCEDURE VIDE ANNX-C. THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN B GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE VIJAYKUMAR A. PATIL ORAL ORDER This writ petition is filed challenging the order dated 12.01.2023 passed on I.A.No.5 in O.S.No.928/2012 by the III Additional Senior Civil Judge and CJM, Mysuru (hereinafter referred to as the 'trial Court' for short). 2. Heard Sri Bhanu Prakash H. V., learned counsel for the petitioners; Sri B.S. Nagaraj, learned counsel for respondent No.4; Sri S. Rupesh Kumar, learned counsel for respondent No.11; Sri Shivayogi B. Hallur, learned - 5 - HC-KAR CNR: KAHC010214532023 NC: 2026:KHC:47867 WP No. 9901 of 2023 counsel for respondent Nos.5 to 8 and perused the material available on record. 3. The petitioners filed a suit in O.S.No.928/2012 seeking the relief of declaration, partition and separate possession of the suit schedule property. In the said suit, the plaintiffs filed I.A.No.5 under Order VI Rule 17 read with Section 151 of the Code of Civil Procedure, 1908 (for short, ‘CPC’), seeking amendment of the plaint. A perusal of the application for amendment indicates that the plaintiffs seek to delete paragraph Nos.2 to 9 of the plaint and to insert proposed paragraphs in its place. 4. A perusal of the plaint indicates that, if paragraph Nos.2 to 9 are deleted, nothing remains in the pleadings. The plaintiffs intend to substitute the said paragraphs by incorporating new paragraphs, that too after commencement of the trial, which is impermissible. The proposed amendment is also sought without due diligence. Hence, the trial Court, vide order dated 12.01.2023, has rightly rejected the said application. - 6 - HC-KAR CNR: KAHC010214532023 NC: 2026:KHC:47867 WP No. 9901 of 2023 5. It is also required to be noticed that, on an earlier occasion, the trial Court, vide order dated 07.02.2019, had allowed the application filed by the plaintiffs in I.A.No.3 under Order VI Rule 17 read with Section 151 of the CPC and permitted the plaintiffs to amend the plaint, and nothing prevented the plaintiffs from seeking the present amendment in the earlier menioned application. In view of the same, the trial Court has rightly rejected I.A.No.5 seeking amendment of the plaint and the same does not call for any interference. 6.
