This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant, who has been arrested in connection with Crime No.416/2026 registered at Police Station Purani Bhilai, District Durg (C.G.), for the offence punishable under Sections 25 & 27 of the Arms Act. 2. As per the case of the prosecution, upon information that on 06.08.2026, the present applicant was brandishing a knife in public place, the police seized the knife and arrested the applicant. Subsequently, the police registered the aforesaid offences, as stated Digitally signed by ALLENA ANJANI KUMAR Date: 2026.10.05 17:33:13 +0530 2 above, against the present applicant. 3. Learned Counsel for the applicant would submit that charge-sheet has already been filed and the applicant is in jail since 06.08.2026 and he is a young boy, aged about 20 years. It is also contended that though there are 5 criminal antecedents, but in 3 criminal cases, he has already been acquitted and two offences are in trivial nature registered under the provisions of BNS, which are pending consideration. He would further contend that conclusion of the trial is likely to take some considerable time. Therefore, he would pray that the bail application may be allowed and the applicant may be enlarged on bail. 4. On the other hand, learned counsel for the State would oppose the submissions advanced by the learned counsel for the applicant. She would submit that while the applicant was brandishing a knife, he was taken into custody and knife was seized from the possession of the present applicant. She would further submit that the present applicant has two live criminal antecedents, therefore, the bail application deserves to be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Having considered the fact that the the applicant has no criminal antecedents of similar nature; two criminal cases of trivial nature registered under the provisions of BNS are pending consideration and that, he has already been acquitted in 3 criminal cases; charge-sheet has already been filed; he is in jail since 06.08.2026 and further conclusion of trial may take some considerable time, I am inclined to 3 grant bail to the applicant.
