Learned counsel for the petitioner has filed a memo to withdraw the writ petition, which reads as under: "MEMO 1. The undersigned counsel appearing on behalf of the Respondent submits that the present Writ Petition has been filed by the Petitioner challenging the tender process initiated by the Respondent. That during the pendency of Digitally Signed by CHEPPUDIRA MONNAPPA POONACHA - 3 - HC-KAR CNR: KAHC010754532025 NC: 2026:KHC:48259 WP No. 35248 of 2025 the present petition, and in the absence of any interim order from this Hon'ble Court restraining the Respondent from proceeding with the tender process, the Respondent finalized the tender and completed the procurement process in accordance with the established rules and procedures. The said procurement was completed, and the items have been duly received and subsequent to the successful completion of the procurement and supply, the Respondent has also released the full and final payment to the L1 bidder. 2. That in view of the aforesaid subsequent developments, the cause of action, as pleaded by the Petitioner, does not survive for adjudication as the entire tender process has been concluded and has attained finality. It is humbly prayed that the present petition, may therefore be kindly rendered infructuous in the interest of justice and equity."
